1. Introduction

These General Conditions regulate the contractual relationship between Moto Rent Pujols S.L. (hereinafter, the “Lessor”) and the client (hereinafter, the “Lessee”), through which the Lessor cedes to the Lessee the use of a vehicle for the term, price, and other conditions indicated in the contract. In the event of a discrepancy between these Conditions and the signed specific conditions, the latter shall prevail. It is the Lessee’s responsibility to carry a copy of the contract while using the vehicle.

2. Lessee Requirements

• Previous experience in riding motorcycles. If the staff observes a lack of skill, they may refuse delivery without a refund.
• Must be over 18 years of age and present a valid National ID or Passport and the original, valid driving license. Photos or replacement reports are not accepted.
• Declare that they hold the appropriate license for the rented vehicle.
• For drivers from outside the EU/EEA, an International Driving Permit is recommended (information here).

3. Bookings, Modifications, and Cancellations

• Bookings are made at www.motorentpujols.com, by paying at least the minimum required deposit.
• Minimum rental period: 1 day (24 h).
• Modifications or cancellations: via email from the same address used for the booking or at reservas@motorentpujols.com.
• Penalty: 1 day of rental per vehicle if the free cancellation/modification supplement is not purchased (available up to 24 h before).

4. Delivery and Return

The vehicle is delivered in perfect condition, with tires and accessories (keys, helmet, padlock, etc.). The client must verify this and has 1 hour to report any anomalies. The vehicle must be returned on the agreed date, time, and location, with the indicated fuel level and in the same condition. The contract begins at the time indicated in the booking and ends when the Lessee delivers the vehicle and accessories to the office. The return time must be respected without exception.

Contract Extensions

• To extend, the Lessee must request it in writing or visit an office before the end of the contracted period.
• Minimum extension duration: 1 day (24 h). It may be extended subject to availability and current conditions.
• The Lessor may demand advance payment for the extension or adjust the deposit and rates.
• Use of the vehicle without authorization after the agreed date/time will be considered unauthorized use, reportable as misappropriation, in addition to generating charges for derived amounts.

The Lessor may deny or withdraw the vehicle if improper driving, alcohol/drug consumption, or physical incapacity is detected. It is strictly forbidden to take the vehicle off the island of Formentera.

5. Contact and Assistance

6. Lessor’s Responsibility

Maintenance and lubrication are included. Repairs or replacements require prior written authorization. Normal wear and tear from reasonable use is covered by the Lessor.

7. Lessee’s Responsibility

• Use the vehicle according to regulations and good practices.
• Safeguard keys, helmet, padlock, and documents; lock and park in a safe place.
• Do not modify, assign, mortgage, or sublease the vehicle.
• Assume damages, fire, or theft, unless excess waiver is contracted (max. excess: 800 €).
• Accessories (helmets, keys, trunks, padlocks, etc.) are not covered by the excess waiver.

7.1 Authorization of Charges

The Lessee expressly authorizes the Lessor to charge the provided payment method for:

• Damages to the vehicle or accessories not covered or exceeding the excess.
• Loss/deterioration of keys, helmets, padlocks, or trunks.
• Missing fuel or incorrect use.
• Fines and administrative expenses (min. 20 €; 50 € if it involves travel to the impound lot).
• Services outside of hours or any expense derived from the breach of these conditions. Charges will be applied after verification and communication to the client’s email.

8. Incidents, Theft, or Accident

• Notify the Police within less than 24 h and file a report if applicable.
• Inform the Lessor and go to the office.
• In accidents with another vehicle, present a joint accident report (amicable statement).
• In case of theft, hand over the keys; otherwise, the full excess will be charged.

9. Coverage and Insurance

The Lessor maintains a mandatory third-party liability policy. Own damage, theft, or fire are subject to an excess unless the waiver is contracted.

10. General Provisions

• Moto Rent Pujols is not responsible for internet or system failures that affect the booking or access.
• These Conditions are governed by Spanish legislation, with both parties submitting to the Courts and Tribunals of the place where the contract is fulfilled.
• Signing implies full acceptance of these Conditions.

ANNEX I

Specific Conditions for Car Rentals

(Applicable only to vehicles managed by Proauto Rent a Car & Autos Isla Blanca Formentera – AutoLlorm Tallers S.L.)

1. Mandatory Documentation

• Valid Credit Card.
• Original and valid driving license.
• Printed copy of the voucher or booking confirmation.

2. Provider and Pick-up Points

• Provider: Oficina Isla Blanca / Proauto.
• For bookings with pick-up at accommodations (Hotel Cala Saona, Hotel Punta Prima), the client will be transferred to the nearest office to formalize the contract.

3. Driver Requirements

• Minimum age: 21 years.
• Minimum experience: 2 years of license for the contracted group.
• Young driver (21-24 years): 3 €/day supplement; they cannot benefit from the excess waiver (Super CDW).
• Additional driver (optional): 3 €/day, max. 35 € per contract.

4. Child Equipment

• Group 0-3 seat: 4 €/day.
• Booster seat: 3 €/day.
• Maximum charge: 54 € per unit.

Must be requested when booking, indicating the model in the comments.

5. Insurance, Excess, and Exemption

• Basic insurance does not cover loss, theft, or damage to transported goods.

6. Fuel

• Return with the same fuel level.
• If incorrect fuel is refilled, costs charged to the client: 200 € + VAT, plus fuel cost.

7. Cancellations

• COVID-19 Flexible: cancellation without cost up to 48 h before (with proof).
• Standard: free cancellation up to 72 h before.

8. After-hours Bookings

• For pick-ups between 21:30 and 23:30, a 35 € VAT included supplement applies.

9. Driving and Permits

• International Permit is mandatory for drivers from non-EU countries.
