GENERAL TERMS AND CONDITIONS OF VEHICLE RENTAL

Moto Rent Pujols S.L.

1. Introduction

These General Terms and Conditions govern the contractual relationship between Moto Rent Pujols S.L. (hereinafter “the lessor”) and the customer (hereinafter “the lessee”), under which the lessor grants the lessee the use of a vehicle for the term, price and other conditions established in the rental agreement.
In the event of any discrepancy between these Terms and the specific conditions signed by the parties, the latter shall prevail.
It is the lessee’s responsibility to carry a copy of the agreement at all times while using the vehicle.

2. Lessee requirements

• Prior experience driving motorcycles is required. If staff determine that the customer lacks sufficient skills, delivery may be refused without refund.
• Must be at least 18 years old and present a valid passport or national ID and the original and valid driving licence. Photos or substitute documents will not be accepted.
• The lessee declares that they hold the appropriate licence for the rented vehicle.
• For drivers from outside the EU/EEA, an International Driving Permit is recommended (information here).

3. Bookings, modifications and cancellations

• Bookings are made via www.motorentpujols.com, paying at least the minimum deposit.
• Minimum rental period: 1 day (24 h).
• Modifications or cancellations: by email from the same address used for the booking or via reservas@motorentpujols.com.
• Penalty: 1 day’s rental per vehicle if the free cancellation/modification supplement is not purchased (available up to 24 h before pick-up).

4. Delivery and return

The vehicle is delivered in perfect condition, including tyres and accessories (keys, helmet, lock, etc.). The customer must check it upon receipt and has 1 hour to report any issues.
The vehicle must be returned on the agreed date, time and place, with the indicated fuel level and in the same condition as delivered.
The rental agreement starts at the time indicated in the booking and ends when the lessee returns the vehicle and accessories to the office. The return time must be respected without exceptions.

Contract extensions

• To extend, the lessee must request it in writing or in person at an office before the end of the agreed period.
• Minimum extension: 1 day (24 h). It may be prolonged depending on availability and applicable conditions.
• The lessor may require advance payment or adjust the deposit and rates.
• Use of the vehicle beyond the agreed date/time without authorisation will be deemed unauthorised use and may be reported as misappropriation, in addition to incurring related charges.

The lessor may refuse or withdraw the vehicle if improper driving, alcohol/drug use, or physical unfitness is detected.
It is strictly forbidden to take the vehicle off the island of Formentera.

5. Contact and assistance

• Offices and assistance: 09:00–13:00 and 16:00–20:00. Outside these hours, the company assumes no responsibility until reopening.

6. Lessor’s responsibility

Maintenance and lubrication are included. Repairs or replacements require prior written authorisation. Normal wear and tear from proper use is borne by the lessor.

7. Lessee’s responsibility

• Use the vehicle in accordance with the law and good practice.
• Keep keys, helmet, lock and documents safe; park in a secure place and lock the vehicle.
• Do not modify, assign, mortgage, or sublet the vehicle.
• The lessee is liable for damage, fire or theft unless the excess waiver has been purchased (maximum excess: €800).
• Accessories (helmets, keys, top boxes, locks, etc.) are not covered by the excess waiver.

7.1 Authorisation for charges
The lessee expressly authorises the lessor to charge the payment method provided for:

• Damage to the vehicle or accessories not covered or exceeding the excess.
• Loss/damage of keys, helmets, locks, or top boxes.
• Missing or incorrect fuel.
• Fines and administrative fees (min. €20; €50 if retrieval from an impound lot is required).
• Out-of-hours services or any costs arising from breach of these Terms.
  Charges will be applied after verification and notification to the customer’s email.

8. Incidents, theft or accident

• Notify the police within 24 h and file a report if required.
• Inform the lessor and visit the office.
• In accidents involving another vehicle, submit the amicable accident report.
• In case of theft, hand in the keys; otherwise, the full excess will be charged.

9. Insurance coverage

The lessor maintains a compulsory third-party liability policy. Own damage, fire or theft is subject to an excess unless the waiver is purchased.

10. General provisions

• Moto Rent Pujols is not responsible for internet or system failures affecting booking or access.
• These Terms are governed by Spanish law; the parties submit to the courts of the place where the contract is fulfilled.
• Signing the agreement implies full acceptance of these Terms.

ANNEX I

Specific conditions for car rental

(Applicable only to vehicles managed by Proauto Rent a Car & Autos Isla Blanca Formentera – AutoLlorm Tallers S.L.)

1. Required documents

• Valid credit card.
• Original and valid driving licence.
• Printed voucher or booking confirmation.

2. Provider and pick-up points

• Provider: Isla Blanca Office / Proauto.
• For bookings with pick-up at accommodation (Drop off in accommodation, Hotel Cala Saona, Hotel Punta Prima), customers will be taken to the nearest office to sign the contract.

3. Driver requirements

• Minimum age: 21 years.
• Minimum experience: 2 years holding the appropriate licence.
• Young driver (21–24): €3/day surcharge; not eligible for excess waiver (Super CDW).
• Additional driver (optional): €3/day, max. €35 per contract.

4. Child equipment

• Child seat group 0–3: €4/day.
• Booster seat: €3/day.
• Max charge: €54 per unit.

Must be requested at booking, indicating the model.

5. Insurance, excess and waiver

• Basic insurance does not cover loss, theft or damage to goods carried.

6. Fuel

• Return with the same fuel level.
• If incorrect fuel is used: €200 + VAT, plus refuelling costs.

7. Cancellations

• Flexible COVID-19: free up to 48 h before (with proof).
• Standard: free up to 72 h before.

8. Out-of-hours bookings

• Pick-ups between 21:30 and 23:30: surcharge €35 incl. VAT.

9. Driving and permits

• International Driving Permit is mandatory for drivers from non-EU countries.
